Welcome to CardNX. By accessing or using our mobile application and services, you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the App.

1. Description of Service & Platform Status

CardNX is an independent card management tool and information searching tool focusing on nostalgic collectible cards. CardNX provides digital archiving, camera-based card scanning (recognition), and collection inventory tracking features for collectors.

• Independent Status: CardNX is an independent platform and is NOT affiliated with, endorsed by, authorized by, or sponsored by any card manufacturers, publishers, or copyright holders.

2. Subscriptions, Fees, and Account Management

CardNX offers premium features through paid subscription tiers, including but not limited to the Advance User and Professional User plans.

• Tier Differences: Your choice of subscription tier dictates your allocated allowances, specifically:
• The volume of the card scanning (recognition) features.
• The number of cards in the card inventory that can be saved and kept within your account.
• Registration & Authentication: Users can create an account and log in using traditional email registration or through Google Authentication (Google Auth). For traditional email registrations, email verification is mandatory to ensure platform security.
• Age Eligibility: CardNX is intended solely for users who are thirteen (13) years of age or older. By using the App, you warrant that you meet this minimum age requirement.
• Billing: Subscriptions are billed on a recurring periodic basis (monthly or annually) via the Google Play Store.
• Cancellation & Account Downgrades: You may cancel your subscription at any time through your Google Play Store account settings. If your account is downgraded or your subscription lapses, your scanning capabilities and access to inventory thresholds exceeding the free tier may be restricted. Billing and refund requests are subject strictly to the standard terms of the Google Play Store.
• Account Deletion Function: CardNX provides an in-app account deletion feature. Users have the right to permanently delete their account and all associated data at any time directly through the App settings or by contacting our support team.
• Inactive Accounts: To optimize system performance and protect user privacy, any account that remains completely inactive for a continuous period of six (6) months may be automatically and permanently deleted by CardNX, including all saved inventory data.

3. Intellectual Property Rights

A. Third-Party Content & Copyright Holders

All card names, descriptions, and images displayed in the App are the sole property of their respective copyright holders. CardNX utilizes these assets purely for informational and identification reference purposes.

B. Image Protection and Reference Standards

To protect the rights of copyright owners and adhere strictly to fair reference standards, CardNX enforces the following technical limitations on third-party imagery:

• Resolution Limits: All card images displayed within the App are strictly limited to low-resolution thumbnails.
• Watermarking: A visible "SAMPLE" stamp/watermark is overlaid onto all card images to prevent unauthorized reproduction or commercial distribution.

If you are a copyright owner and believe that any content within the App infringes upon your rights or exceeds fair reference standards, please contact us for immediate rectification.

C. CardNX Proprietary Rights & Anti-Scraping

The unique arrangement of data, user interface (UI) design, proprietary code, database structures, and analytical tools within CardNX are the exclusive intellectual property of CardNX Limited.

• Anti-Scraping Policy: Users are strictly prohibited from utilizing automated tools (including bots, scrapers, crawlers, or spiders) to extract, harvest, or aggregate card data or user information from CardNX. Unauthorized data harvesting for commercial or competitive use will result in immediate termination of access and potential legal action.

4. Disclaimer and Limitation of Liability

• "As-Is" Data & Service: CardNX provides card data, recognition features, and search capabilities on an "as-is" basis. We do not provide market price information. We do not guarantee that card descriptions, recognition results, or archiving features will be 100% accurate, complete, or uninterrupted at all times.
• No Liability for Data Loss: While we employ secure, industry-standard cloud backend infrastructure to store your inventories, CardNX is not liable for the loss, corruption, or deletion of any card collection data or digital archives logged within the App. Users are advised to maintain independent records of their personal collections.
• Liability Cap: To the maximum extent permitted by law, CardNX and its operator shall not be liable for any indirect, incidental, or consequential financial losses (including duplicate card purchases or perceived loss of hobby/commercial value) arising from app downtime or data errors. Our total aggregate liability for any direct claims is strictly capped at the total amount you paid for your subscription during the twelve (12) months prior to the claim.

5. External Links and Commercial Transactions Disclaimer

• Informational Routing: CardNX may display stock availability or provide hyperlinks to external online stores where physical items can be purchased. CardNX acts strictly as an informational registry for these links.
• No Marketplace Liability: CardNX does not process physical transactions, payments, or shipping fulfillment within the App. Any purchase, financial transaction, shipping dispute, or return policy is strictly governed by the external destination website's terms of sale. CardNX Limited assumes no liability, responsibility, or warranty for any products purchased or transactions executed on external websites.

6. Governing Law

• Jurisdiction: These Terms of Use are governed by the laws of the Hong Kong Special Administrative Region (HKSAR). Any legal disputes or claims arising from your use of CardNX shall be settled exclusively in the courts of Hong Kong.
